BreakMyBadHabit.com (“Platform”) is a service designed to help users break habits through goal-setting and financial incentives.
These Terms of Service (“Terms”) govern your use of the Platform, including mobile and web applications, and all related services.
2. Eligibility
You must be at least 18 years old to use the Platform.
You must be legally competent, not under guardianship, a registered citizen and you must not have financial debts to use the Platform
You are responsible for providing accurate and up-to-date information during registration.
The Platform is not responsible for false or misleading information provided during signup.
3. Use of the Platform
Goal Setting: Users set a goal for habit-breaking and a duration (e.g., 21 days).
Financial Commitment: Users agree to stash an amount of money on the Platform as motivation.
Progress Tracking: Users self-report their progress on a daily basis.
Pro Rata Payouts: Users receive a portion of their stashed amount daily, based on the total duration.
4. Financial Terms
Funds Handling: The stashed money is held in a designated account managed by the Platform. The Platform is not a financial institution and does not pay interest on stashed funds.
Refunds and Payouts: Funds are returned daily on a pro-rata basis when users report successful progress. If a user fails to log progress for a day, the corresponding portion of funds for that day is forfeited. No refunds are issued for forfeited funds.
Restitution of Funds: Any money earned back by users will be transferred within 180 days after the completion of the habit-breaking period.
Non-Compliance: If a user abandons the program (fails to log progress for consecutive days without completing the goal), the remaining funds are forfeited.
Service Fees: The Platform may charge an administrative fee, which is deducted from the stashed amount.
Transaction Fees: Users are responsible for any transaction fees incurred, which will be deducted from the stashed amount.
5. User Responsibilities
Users must provide honest and accurate progress updates.
The Platform is not responsible for verifying progress; the program relies on self-reporting.
Users must not use the Platform for illegal, fraudulent, or harmful activities.
Users declare that they will not use the Platform for money laundering or any financial goals other than those intended by the Platform.
Users commit to abiding by all applicable laws and regulations.
Users agree to notify the Platform of any suspicious situations or changes in personal circumstances, such as legal competence, financial debt or any other situation that may be relevant to the use of the Platform.
6. Disclaimer of Liability
The Platform is a motivational tool and does not guarantee habit-breaking success.
The Platform is not a substitute for professional advice, therapy, or medical treatment.
The Platform is not liable for financial loss due to forfeited funds, disputes regarding self-reported progress, or technical issues affecting app functionality.
7. Data Privacy
The Platform collects and processes personal data in accordance with its Privacy Policy.
Users are responsible for maintaining the confidentiality of their login information.
8. Prohibited Activities
Provide false progress reports.
Attempt to manipulate the system for financial gain.
Use the Platform for any activity that violates local laws or regulations.
9. Termination
The Platform reserves the right to suspend or terminate accounts for violating these Terms, engaging in fraudulent activities, or abandoning the program without completing the goal.
In cases of termination, remaining funds (after fees) may be forfeited.
10. Changes to the Terms
The Platform may update these Terms at any time. Users will be notified of significant changes via email or in-app notification. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
11. Governing Law and Dispute Resolution
Users must comply with all applicable local laws while using the Platform.
Disputes arising from these Terms will be resolved through negotiation between the user and the Platform. In the case of no agreement, the Platform will have the final word.
